This article argues that the traditional jus ad bellum and jus in bello criteria are fully capable of providing the ethical guidance needed to legitimately conduct military cyber operations. The first part examines the criteria’s foundations by focusing on the notion of liability to defensive harm worked out by revisionist just war thinkers. The second part critiques the necessity of alternative frameworks, which its proponents assert are required to at least supplement the traditional just war criteria. Using the latter, the (...) third part evaluates ethical issues germane to responding to cyber force, including casus belli, moral aspects of “the attribution problem,” and respective rights and duties when attacks involve innocent third-party states. The fourth part addresses in bello issues, including compliance with discrimination, necessity, and civilian due care imperatives; whether civilians may be targeted with sub-“use of force” cyber-attacks and the permissibility of using civilian contractors to conduct cyber-attacks. The Alleged Turning Point in European Philosophy Existentialists, especially those who follow either Heidegger or Jaspers, find a great deal objectionable in what they variously call ‘scientism’, ‘scientific rationalism’, and ‘positivism’. In this article I shall discuss one of the alleged defects of scientific rationalism, that it recognizes only one kind of truth—the kind that existentialists call ‘objective truth’. ‘One great achievement of existential philosophy,’ writes William Barrett, ‘has been a new interpretation of the idea of truth in order (...) to point out that there are different kinds of truth, where a rigid scientific rationalism had postulated but one kind: objective scientific truth.’ Not only scientific rationalists but traditional metaphysicians from Plato to Aquinas and Hegel are judged to be equally at fault here: they too have failed to recognize any truth other than the objective variety. It was Kierkegaard who for the first time effectively challenged the assumptions shared by scientific rationalists and traditional metaphysicians. Kierkegaard, in Barrett's words, ‘had to re-open the whole question of the meaning of truth … his stand on the question may well have marked a turning point in European philosophy.’. (shrink)

Standard models of concept learning generally focus on deriving statistical properties of a category based on data (i.e., category members and the features that describe them) but fail to give appropriate weight to the contact between people's intuitive theories and these data. Two experiments explored the role of people's prior knowledge or intuitive theories on category learning by manipulating the labels associated with the category. Learning differed dramatically when categories of children's drawings were meaningfully labeled (e.g., “done by creative children”) (...) compared to when they were labeled in a neutral manner. When categories are meaningfully labeled, people bring intuitive theories to the learning context. Learning then involves a process in which people search for evidence in the data that supports abstract features or hypotheses that have been activated by the intuitive theories. In contrast, when categories are labeled in a neutral manner, people search for simple features that distinguish one category from another. Importantly, the final study suggests that learning involves an interaction of people's intuitive theories with data, in which theories and data mutually influence each other. The results strongly suggest that straight‐forward, relatively modular ways of incorporating prior knowledge into models of category learning are inadequate. More telling, the results suggest that standard models may have fundamental limitations. We outline a speculative model of learning in which the interaction of theory and data is tightly coupled. The article concludes by comparing the results to recent artificial intelligence systems that use prior knowledge during learning. (shrink)

Theories of emotion have often maintained artificial boundaries: for instance, that cognition and emotion are separable, and that an emotion concept is separable from the emotional events that comprise its category (e.g. “fear” is distinct from instances of fear). Over the past several years, research has dissolved these artificial boundaries, suggesting instead that conceptual construction is a domain-general process—a process by which the brain makes meaning of the world. The brain constructs emotion concepts, but also cognitions and perceptions, all in (...) the service of guiding action. In this view, concepts are multimodal constructions, dynamically prepared from a set of highly variable instances. This approach obviates old questions (e.g. how does cognition regulate emotion?) but generates new ones (e.g. how does a brain learn emotion concepts?). In this paper, we review this constructionist, predictive coding account of emotion, considering its implications for health and well-being, culture and development. (shrink)

Given Heidegger’s inflammatory remarks about the intellectual poverty of modern logic, it may come as a surprise to be told that he has something to contribute to the philosophy of logic. One of the rewards of Daniel Dahlstrom’s Heidegger’s Concept of Truth is its argument that Heidegger can illuminate such issues in the philosophy of logic as the character of propositions, the nature of bivalence, and the concept of truth. This essay explores the controversy over peer-to-peer (p2p) software, examining the legal and ethical dimensions of allowing software companies to develop p2p technologies. It argues that, under the Supreme Court’s ruling in the Sony betamax case, technology developers must be accorded the freedom to innovate and develop technologies that are capable of substantial noninfringing uses. This doctrine, known as the Sony doctrine, provides an important safe harbor for technological development, including p2p. The safe harbor, however, does not immunize conduct beyond (...) the design, sale, or supply of the product. For other conduct that falls outside the Sony safe harbor, the traditional standards of secondary liability apply. (shrink)

There is significant interest in type-free systems that allow flexible self-application. Such systems are of interest in property theory, natural language semantics, the theory of truth, theoretical computer science, the theory of classes, and category theory. While there are a variety of proposed type-free systems, there is a particularly natural type-free system that we believe is prototypical: the logic of recursive algorithms. Algorithmic logic is the study of basic statements concerning algorithms and the algorithmic rules of inference between such statements. (...) As shown in [1], the threat of paradoxes, such as the Curry paradox, requires care in implementing rules of inference in this context. As in any type-free logic, some traditional rules will fail. The first part of the paper develops a rich collection of inference rules that do not lead to paradox. The second part identifies traditional rules of logic that are paradoxical in algorithmic logic, and so should be viewed with suspicion in type-free logic generally. (shrink)

Willard Van Orman Quine's work revolutionized the fields of epistemology, semantics and ontology. At the heart of his philosophy are several interconnected doctrines: his rejection of conventionalism and of the linguistic doctrine of logical and mathematical truth, his rejection of the analytic/synthetic distinction, his thesis of the indeterminacy of translation and his thesis of the inscrutability of reference. In this book Edward Becker sets out to interpret and explain these doctrines. He offers detailed analyses of the relevant texts, discusses (...) Quine's views on meaning, reference and knowledge, and shows how Quine's views developed over the years. We agree with Heyes that an explanation of human uniqueness must appeal to cultural evolution, and not just genes. Her account, though, focuses narrowly on internal cognitive mechanisms. This causes her to mischaracterize human behavior and to overlook the role of material culture. A more powerful account would view cognitive gadgets as spanning organisms and their (shared) environments.

On January 11, 2024, the United Kingdom (U.K.) Supreme Court rendered its judgment in _Paul v Royal Wolverhampton NHS Trust_, restricting the circumstances in which “secondary victims” can successfully claim for damages in clinical negligence cases. This ruling has provided welcome clarity regarding the scope of negligently caused “pure” psychiatric illness claims, but the judgment may well prove controversial. In this article, I trace the facts and opinion from the majority and also discuss an important dissenting opinion. I then reflect (...) on what the ruling means for psychiatric illness claims by secondary victims, and more broadly on the implications for clinical negligence law. I suggest that while much-needed clarity has been injected in this area of the law, it is difficult, reading the majority of the Supreme Court’s emphasis on the restricted scope of a medical practitioner’s duty, to envision a scenario in which secondary victim could ever succeed in a clinical negligence context. Imprecise probabilities are often modelled with representors, or sets of probability functions. In the recent literature, two ways of interpreting representors have emerged as especially prominent: vagueness interpretations, according to which each probability function in the set represents how the agent's beliefs would be if any vagueness were precisified away; and comparativist interpretations, according to which the set represents those comparative confidence relations that are common to all probability functions therein. I argue that these interpretations have some important limitations. I (...) also propose an alternative—the functional interpretation—according to which representors are best interpreted by reference to the roles they play in the theories that make use of them. The modal object calculus is the system of logic which houses the (proper) axiomatic theory of abstract objects. The calculus has some rather interesting features in and of itself, independent of the proper theory. The most sophisticated, type-theoretic incarnation of the calculus can be used to analyze the intensional contexts of natural language and so constitutes an intensional logic. However, the simpler second-order version of the calculus couches a theory of fine-grained properties, relations and propositions and serves as a framework (...) for defining situations, possible worlds, stories, and fictional characters, among other things. In the present paper, we focus on the second-order calculus. The second-order modal object calculus is so-called to distinguish it from the second-order modal predicate calculus. Though the differences are slight, the extra expressive power of the object calculus significantly enhances its ability to resolve logical and philosophical concepts and problems. (shrink)

First published in 1984, this book carefully dissects and convincingly demonstrates that conservative economics is incoherent in theory and disastrous in practice. The three main schools of thought supporting "free-market" policies – supply side economics, monetarism and rational expectations – are examined in turn and each is found defective. Three case studies of conservative policy in action follow: Reagan’s U.S., Thatcher’s U.K. and Pinochet’s Chile and their courses are charted in depth. In addition, Robert Heilbroner and Edward Nell analyse (...) economic conservatism’s ideology and social policy, and the book concludes with an assessment of the political reasons for the continuing appeal of free-market conservatism despite its theoretical incoherence and practical failure. This is a careful and comprehensive look at this subject which tackles both the theory and the practice head-on. It will make useful and stimulating reading for students of economics and political economy on courses of economic policy and macro-economics and in addition will be of keen interest to all those involved in the debate about one of the major policy issues of our time.
